Facility Rental Agreement

The Commons is a community center occupying the first floor at 388 Atlantic Avenue. The space is available for rental by private individuals and groups during times when it is not in use by the Commons. Since this is a community center with no paid staff, use of the space by outside groups is necessarily held to a minimum. Melissa Ennen will approve requests on a case-by-case basis.

The Common’s maximum capacity is about 150 people for a stand-up event and about 90 for a sit-down affair. One hundred banquet chairs and eight folding tables are available. Catering is allowed and a residential-style refrigerator is sometimes available.

Smoking is not permitted on the premises. Underage drinking is not permitted and is the responsibility of the Renter.

All events must be over, with clean-up completed, by 2 a.m. All persons must be out of the building at this time. If anyone remains in the building after 2 a.m. for any reason, an additional fee of $300 per hour will be applied.

Rental Fees: Set-up and clean-up time must be calculated into the time the facility is needed. Depending on the size of the event, the superintendant of the building must be present during the event for security, lock up and assistance.  The renter agrees to pay the superintendant $15 per hour in addition to the base rental fee. Half of the rental fee (plus the appropriate fee for the superintendant) is due when this agreement is signed; the remainder is due at least one week in advance of the scheduled event. Checks are made payable to 388 Atlantic Avenue Inc.

Security Deposit: A security deposit of is due at the time of completion of this Agreement. The deposit will be held until after the event and returned after inspection of the space. Portions of the deposit may be retained to compensate for late departure, damages or additional clean up costs attributable to the Renter.

Cancellation / Refund: If Renter cancels more than 30 days before the scheduled use of the facilities, the security deposit will be returned. If Renter cancels less than 30 days prior to the event, half of the deposit will be refunded.

Returned Checks: There will be a $30 fee for any returned check.

Responsibility:  The conduct of all participants while at the Commons shall be the responsibility of the Renter. Renter also accepts all responsibility for any injury to person(s) or property, or loss of or damage to property or theft of property at the Commons (first floor of 388 Atlantic Avenue) during the rental period, or resulting therefrom. The Commons retains the right to evict objectionable persons from the premises or to call for security/police help if deemed necessary. Violations may result in denial of future reservation requests.

Indemnity: Renters shall release, indemnify, keep and save harmless 388 Atlantic Avenue, Inc. its agents, officers, employees, or members from any and all responsibility or liability for any and all damages or injury of any kind or nature whatever (including death) to all persons, whether agents or employees of the Renter or persons attending the events for which the premises have been leased, and to all property damage proximately caused by, incident to, resulting from, arising out of, occurring in connection with, the use by the Renter of the premises. The provisions of this section shall include any and all losses, damages, injuries, settlements, judgments, decrees, awards, fines, penalties, claims, costs and expenses, including reasonable attorney‘s fees.

Set-up: Access to the facilities for setting up, including caterer’s set-up, will be during the hours stated on this rental agreement or as agreed to in advance. Renter is responsible for all set-up and break down. The Commons may request a written schedule for set up, event, and clean up if deemed necessary.

Cleanup: The premises must be left in the condition in which they were found at the beginning of the rental period and will be approved by a Commons representative. All food, beverages, equipment and rented supplies must be removed from the premises immediately after each use of the facilities. All trash must be removed from the building. All floors must be swept after use of the space. Renter must immediately take care of any spillage. If renter is unable to remove spillage, the Commons retains the right to have the area professionally cleaned at the Renter’s expense.

Damage: Any damage to facilities during the rental period or resulting from any caterer’s action will be the responsibility of the Renter. This includes damage to the walls, floors, fixtures, appliances or sound system.

The Renter agrees to rent a portion of 388 Atlantic Avenue during the stated dates and times, in accordance with the terms of this Rental Agreement. The space will be available to the renter during the times stated on the face of this agreement only. Renter therefore should include sufficient time for set-up and cleanup. Rental fees are based on a block of time and are inclusive of the set-up and cleanup time.
